LONE MOUNTAIN WAGYU REWARDS PROGRAM TERMS
Effective Date: April 19, 2017
PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THE LONE MOUNTAIN WAGYU REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE LONE MOUNTAIN WAGYU REWARDS PROGRAM.
These Lone Mountain Wagyu Rewards Program Terms (“Rewards Terms”) apply to your access to and participation in the Lone Mountain Wagyu Rewards Program (“Rewards Program”), which is operated by Lone Mountain Wagyu, LLC or its affiliates, (collectively, “Lone Mountain Wagyu", “our”, “us” or “we”). These Rewards Terms do not alter in any way the terms or conditions of any other agreement you may have with Lone Mountain Wagyu for other products and services. In addition, these Rewards Terms complement and incorporate by reference the Lone Mountain Wagyu Terms and Conditions. In the event of any conflict between the Lone Mountain Wagyu Terms and Conditions and these Rewards Terms, the Lone Mountain Wagyu Terms and Conditions will control.
Lone Mountain Wagyu reserves the right to change, modify and/or eliminate the Rewards Program and/or all or any portion of these Rewards Terms or any policy pertaining to the Rewards Program at any time and in its sole discretion, including our right to discontinue or change the benefits or change the expiration date of rewards points or “Rewards Codes” (defined below) received under the Rewards Program, merge the Rewards Program with another rewards program, or to adjust how rewards points are earned, calculated or redeemed. It is possible that you may be unable to receive enough rewards points to redeem a Rewards Code if we discontinue the Rewards Program or merge the Rewards Program into another rewards program. If we make changes, we will post the amended Rewards Terms to www.LoneMountainWagyu.com/rewards and update the “Effective Date” above. We may also attempt to notify you in other ways. Unless we say otherwise, the amended Rewards Terms will be effective immediately and your continued participation in the Rewards Program after the amended terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Rewards Terms, you must stop participating in the Rewards Program.
You must be a United States resident (including residents of U.S. Territories), who is at least 18 years of age to participate in the Rewards Program. The Rewards Program is intended for personal use only and commercial use by commercial customers and others purchasing items for resale are not eligible to participate in the Rewards Program. Current Lone Mountain Wagyu employees and contractors, and immediate family members of current Lone Mountain Wagyu employees and contractors, are not eligible to participate in the Rewards Program.
3. Program Description
The Rewards Program is a free to join customer loyalty program that allows participants to earn rewards points with every purchase on LoneMountainWagyu.com. Participants may also earn rewards points by participating in Promotional Activities (defined in Section 5) that may be offered through the Rewards Program from time to time. Participants of the Rewards Program may redeem accumulated rewards points for rewards codes (“Rewards Codes”) that can be used toward purchasing items on LoneMountainWagyu.com. 4. Joining the Rewards Program
There are no membership fees associated with the Rewards Program. To sign up, complete [one of] the following:
Once enrolled in the Rewards Program, you can view and manage your Rewards Program account through your Lone Mountain Wagyu Account rewards popout. You may only have one Rewards Program account, and it is nontransferable.
5. Earning Points
The benefits that are available to you through the Rewards Program are based on the number of rewards points that you earn by making purchases on LoneMountainWagyu.com or otherwise participating in Lone Mountain Wagyu Rewards Program Promotional Activities.
In order to receive rewards points for a purchase, you must place your order on LoneMountainWagyu.com while you are logged into your Lone Mountain Wagyu Account that is associated with your Rewards Program account. You will earn rewards points based on the total amount paid for your purchase, including tax and shipping but excluding any discounts, and purchases made solely with Rewards Codes or other discount codes (“Net Purchase”) at the rate of one point for each One Dollar ($1.00) you spend on LoneMountainWagyu.com. Points will also be earned by following the official Lone Mountain Wagyu social media accounts at the rate of 10 points per follow of Instagram and Twitter. Purchases made from any successor website or any other websites owned or operated by Lone Mountain Wagyu are not eligible for Rewards Program points or other benefits unless otherwise indicated.
Promotional Activities and Events.
From time to time, we, or others acting with our permission, may offer you opportunities to earn bonus rewards points, such as by inviting you to engage with Lone Mountain Wagyu in promotional events or activities (e.g., sharing pictures or videos, making mobile purchases, following on social media, etc.) in exchange for rewards points (collectively, “Promotional Activities”).

Promotional Activities (and the terms of each Promotional Activity) may be communicated to you via email, via the Rewards Program page, the homepage on LoneMountainWagyu.com, or any other form of communication as solely determined by Lone Mountain Wagyu. Rewards points for participation in Promotional Activities will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in the promotional offer. Some Promotional Activities may limit the amount of rewards points earned per Promotional Activity. Rewards points for eligible participation in Promotional Activities may take seven or more days to be added to your Rewards Program account.
6. Using or Redeeming Rewards Program Points
Once you reach the number of points required for redemption, you can redeem them for a Rewards Code, which will be applied to future LoneMountainWagyu.com purchases. You can redeem your points for Rewards Codes by accessing the rewards popout on www.lonemountain.com and selecting “Get Rewards.” Minimum redemption for Rewards Codes is 100 points and points are only redeemable in the increments set forth on the “Get Rewards” section of the popout. Rewards Codes will be issued within 24 hours of your request via email.
Rewards points accumulated under the Rewards Program are promotional and have no cash value. Rewards Codes have no cash value and cannot be applied to previous purchases. Your rewards points, Reward Codes and your Rewards Program account are personal to you and may not be sold, transferred (by operation of law or otherwise) or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You are responsible for any taxes related to your participation in the Rewards Program.
Discounts provided through Rewards Program may not be eligible with other promotions.
LONE MOUNTAIN WAGYU RESERVES THE RIGHT WITHOUT NOTICE TO AUTOMATICALLY CONVERT YOUR REWARDS POINTS TO A DIFFERENT MEASUREMENT; OR CONVERT YOUR REWARDS POINTS TO REWARDS CODES AT ANY TIME AND DEDUCT SUCH REWARDS POINTS FROM THE REWARDS POINT TOTAL ON YOUR REWARDS PROGRAM ACCOUNT. IN THE EVENT LONE MOUNTAIN WAGYU CONVERTS YOUR ELIGIBLE REWARDS POINTS TO REWARDS CODES, LONE MOUNTAIN WAGYU WILL ISSUE THE CORRESPONDING REWARDS CODES TO THE ELIGIBLE ENROLLED REWARDS PROGRAM ACCOUNT. UNUSED REWARDS CODE AMOUNTS CANNOT BE REISSUED OR ADDED BACK TO YOUR ACCOUNT POINT TOTAL. SOME REWARDS CODES MAY NOT BE COMBINED WITH OTHER OFFERS OR PROMOTIONS AND WILL BE SUBJECT TO THE ADDITIONAL TERMS CONTAINED ON THE REWARDS CODE.
7. Returns and Points/Rewards Code Refunds
If you return merchandise that you purchased with your Rewards Codes, you will be refunded the amount you paid (excluding the value of the Rewards Codes). So, if you place an order totaling $100 for one item and used a $10 Rewards Code, then we will refund $90 to your original method of payment. However, you will not receive a replacement Rewards Code and Lone Mountain Wagyu will not credit the redeemed rewards points to your account. Note that if you purchase multiple items using a single Rewards Code, then the value of your Rewards Code is applied proportionality to each item, and returns of any one item will be result in a refund of the amount you paid excluding the value of the proportionally applied value of the Rewards Code.
If you void a purchase or return your purchase after converting any rewards points earned into Rewards Codes, Lone Mountain Wagyu will deduct the rewards points that you were awarded for that purchase, potentially resulting in a negative rewards point balance in your Rewards Program account.
Without notice to you, Lone Mountain Wagyu reserves the right to suspend or terminate your account and/or your participation in the Rewards Program if Lone Mountain Wagyu determines in its sole discretion that you have violated these Rewards Terms, you have more than one account, or that the use of your account or your participation in the Rewards Program is unauthorized, deceptive, fraudulent or otherwise unlawful. Lone Mountain Wagyu may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in the Rewards Program is terminated, you will not be able to redeem any accumulated Rewards Points.
Without notice to you, Lone Mountain Wagyu also reserves the right to “unregister" and make ineligible for the Rewards Program an account that is inactive. An inactive account is defined as an account that has not earned points for one year. In the event that your Rewards Program account is unregistered or rendered inactive, then you will no longer be eligible for Rewards Program benefits, including converting your Rewards points into Rewards Codes. You may reactivate your account by logging into your account or making a purchase using your account.
